Canada Record Suspension

A record suspension (formerly known as a pardon) keeps a judicial record of a conviction separate and apart from other criminal records, and gives law abiding citizens an opportunity to reintegrate into society.

It removes all information about the conviction from the Canadian Police Information Centre (CPIC) database. Federal agencies cannot give out information about the conviction without approval from the Minister of Public Safety Canada. A record suspension removes disqualifications caused by a criminal conviction, such as the ability to contract with the federal government, or eligibility for Canadian citizenship.

Important points:

  • A record suspension does not erase the fact that you were convicted of a crime. Your criminal record is not erased, but it is kept separate and apart from other criminal records.
  • A record suspension has no effect on a prohibition order.
  • If you are convicted of a new offence, the information may lead to a reactivation of the file in CPIC.

Before you apply for a record suspension, you must have completed all of your sentences, which includes:

  • all fines, surcharges, costs, restitution and compensation orders;
  • all sentences of imprisonment, conditional sentences, including parole and statutory release;
  • any probation order(s).

After completing all of your sentences, you must have completed a waiting period:

  • 5 years for a summary offence (or a service offence under the National Defence Act).
  • 10 years for an indictable offence (or a service offence under the National Defence Act for which you were fined more than $5,000, detained or imprisoned for more than 6 months). 

How to apply

  • Bring 2 pieces of Canadian photo ID to your appointment (acceptable IDs)

US Waiver

US Waiver

Applying for a US entry waiver is a complicated and time-consuming process, which is why you should acquire the expertise of professionals. If you have not been allowed entry into the United States for any reason, you will need to find out why and then apply for a US Waiver and submit it to the Department of Homeland Security. The reason of denial can be one or more of these reasons:

  • You have overstayed your welcome in the US (over 6 months in the country without status)
  • You have worked illegally in the United States
  • You have been convicted/charged with a criminal offence in Canada and/or the United States
  • You have been caught at the border with fraudulent documentation, narcotics or other contra ban
  • You have been deported from the United States

What makes the situation confusing for people is that a lot of people have crossed the border for several years before they were denied entry. A border agent may refuse your entry request for a criminal record that dates back to years ago. This can create problems for people who are trying to enter the United States for recreation, family, or work. However, irrespective of why you were refused entry to the United States, a US entry waiver is the only solution.

US waivers can be filed from any country including Canada and they allow people who have been convicted of a criminal offence to legally enter the United States and overcome their inadmissibility to the USA. US Waivers are valid for up to 5 years, after which time they must be renewed. Inadmissibility to the United States can affect your personal freedom and excludes you from trusted traveller programs like NEXUS, the Global Entry Program and the FAST pass.

If you have been denied access to the United States on the grounds of inadmissibility, an entry waiver will help you regain entry. Ink and Roll Fingerprinting

CROSS-CHECKS™ is accredited by the RCMP and is authorized to provide ink and roll fingerprinting services. Our facility features the latest ink and roll station model, complete with a ceramic ink pad. Notably, this pad minimizes the ink residue on your fingertips, setting it apart from traditional pads. The ink and roll fingerprinting card is a mandatory document when applying for an FBI record check (abbreviated as Identity History Summary Checks or IdHSC) from Canada. Additionally, to secure a police certificate from foreign countries while staying in Canada, it is essential to provide your ink and roll fingerprint card along with the required documents to the appropriate foreign government branch.
